Occupy Madison Inc. is working hard to create OM House (housing cooperative) and is working on other projects like OM Works (worker cooperative) to create opportunities for housing and work for those who currently are struggling in this economy.  We hope you can join us for our fundraiser tonight!

GOOD NEWS . . . BAD NEWS . . . GOOD NEWS

GOOD:  With your help and all of those listed below, we have raised over $11,000 leading up to our Occu-PIE fundraiser which is tonight 5 – 7:30 at the Fountain Bar (122 State St.).  We’re off to a great start!

BAD:  Our offer to purchase the building at 2132 Fordem Ave. has been rejected in favor of an alternate offer.  This is the second time we were seriously looking at a building that was then “taken off the market”.  Additionally, we have gotten word that the folks camping at Token Creek have to be out of the campground on February 17th and they have no legal place to go.

GOOD:  We’re not giving up!  We’ve got some more buildings we are looking at and continuing the efforts to get people currently without homes into housing!  Forward!

Please read below to find out why this is so important!

Dear Concerned Community Member -

We are writing you today because we believe, like you, that human beings should not be sleeping in a tent in the cold Wisconsin winter. However, that is the case for over 300 Madison and Dane County residents right now. We know this, because we work with many grassroots and private community partners to help support the people living in tents and outdoors throughout the Madison area.

Many people ask us, “why“? Why are people “choosing” to live outside instead of in the shelters. For many, it is not a “choice”, it is a fact of life.

- Both the men’s and women’s shelters have a 60 day limit (with exceptions for cold weather under 20 and 22 degrees respectively). Those days renew every year, but for about 75% of the year they have no shelter to go to, and they often save their shelter days for the coldest days of the year.
- The women’s shelter only has beds for 30 – 35 women, the rest are turned away. Additionally, the women have to participate in a lottery every night and have no guarantee where they will be sleeping.
Families have only 90 days in shelter per year and have a 180 day lifetime limit. Although a Warming House exists in the evenings for the families, they can only stay there one night at a time and then have to give up their slot for another family in need.
- The Domestic Violence Shelter turns people away on a regular basis. At a recent homeless services meeting we were told that if someone is about to leave their abuser, they should plan ahead to get on the waiting list to make it more likely they would have shelter.
- – Working homeless with 2nd or 3rd shift jobs don’t get enough sleep during the times the shelter is open.
- – People who are too sick are turned away.
- – Couples without children are forced to be separated to get shelter.
- - Transgendered and gay and lesbian people often find shelter difficult and are harassed in the shelter system.
- – Unaccompanied youth report fears of going to the shelter and that they fear for their safety.
- – Stories of bed bugs, rapidly spreading illnesses, noisy sleeping environments, unclean facilities, stealing and much more prevent people from choosing shelter.
- – Some people have been banned from shelter and have no independent third party to appeal to.
- – Others simply have difficulty with the group living environment or being locked in at night.

Can you imagine “choosing” to sleep outside in a tent instead of a warm bed? It is not a choice people make lightly, if it is a choice at all.

Much of this became apparent at Occupy Madison, where people chose to live on a parking lot as it was an upgrade to other available options. We also discovered that we were creating something new — a shared, inclusive community where everyone could contribute and influence what happened and how as well as benefiting from the support of each other.

All summer long we have been looking for alternatives to living outside on the streets or to hidden & cold tents before the winter came, and we are pleased we finally believe we have found an initial model for a long-term solution! OM House

! However, this can only be done with the community’s help.Thanks to a donor and much help from volunteers, we are opening a 20 unit residence for the people living who are currently without homes. This will be different as it will be a housing co-operative where the people living there determine much of what happens and how the building is run, as well as consolidating opportunities for local services and increasing the opportunities to work together and learn from each other.

Before this becomes a reality, there is a lot of hard work left to be done, and we need to raise about $100,000 in the next few months to make it happen. We have the money for the down payment ($31,500), we need money for the necessary improvements to the building ($75,000) and initial operating costs for the first few months. After that, we believe we with some additional zoning changes we can charge a modest amount of rent ($200 or less) and get grants and refinance to lower our monthly payments.

What can you do to help?

Occu-PIE — Celebrate & Fundraiser: The Fountain January 29, 2013

Join us for a fundraiser to help us raise $100,000 so we can create housing to get 20 people off the streets/out of tents and provide a non-profit incubator for small grassroots organizations serving homeless persons. We have $31,500 to put down a downpayment on the building, we need $75,000 more for construction on the building and then $25,000 more towards creating the building and for some operating funds to get started. We’ve been working on this for just two months and things are moving fast and its very exciting – join us to celebrate, learn more about the project, enjoy some pie, enjoy music by Combustible Trio and of course, help us raise funds to make it happen!

MEMBERSHIPPING PROCESS
- A waiting list will be maintained, based primarily on seniority.  Only members of Occupy Madison, Inc. who are in good standing are allowed to be on the waiting list.
- When an opening becomes available, the next person on the waiting list will be notified that they can begin the membershipping process by attending house meetings and be given a copy of these policies.
- The applicant must attend three consecutive house meetings.
- Following the three meetings, the applicant will be interviewed. (need to develop interview questions)
- Members will discuss the person and decide on whether or not they should be allowed into the house.
- A person needs to be voted in (YES vote, abstentions don’t count) by 75% of ALL
occupants (including those not at the meeting. If there are 20 total residents and 5 (25%) are
out of town and one person abstains, the membershipper is NOT voted in unless some of those five people vote by proxy).
- Any member can block an applicant from becoming an occupant (but they must have a good reason!).
- If the vote is successful, they will sign a commitment to the house rules.
- There will be a two week trial period, after which another House Meeting will determine whether or not the person can stay.
- After those two weeks, the person is a full occupant and may sign a lease. (month to month)

BACKGROUND CHECKS AND ENTRY DECISIONS
Fair Housing
In addition to the above membershipping process, any member of OM house will be entitled to full rights under federal, state and local fair housing laws.  We will not discriminate based on race, color, religion, gender, national origin, mental or physical disability, familial status (including pregnancy), age, sexual orientation (gay, straight, bisexual, queer). marital status, ancestry, lawful source of income, victims of domestic violence, abuse or other crimes, type of military discharge, physical appearance, gender identity (including transgendered persons), domestic partnership status, genetic identity, political beliefs, student status, receipt of rent assistance (Section 8) and citizenship status.

The group has also decided to extend the local fair housing protections that existed prior to passage of 2011 Wisconsin Act 108 which means they will extend some protections on arrest and conviction records (slightly modified), disclosure of social security numbers and minimum income standards.

Standard Screening Practices
Traditionally, landlords screen tenants and check in the following areas:
___  Amount of Income ___ Landlord References ____ Eviction & Civil Court Records
___  Credit ___  Conviction Record

We will check all of these items, however they will not be used a basis for denial.  Instead, this information will be used to help applicants address issues discovered so that they can obtain regular market housing.  Information will be used in the following ways:

Income:  To assist in determining eligibility for benefits and services.

Landlord References:  To assist in determining if there are behavior issues to be listed as goals for the applicant or determine if a payment plan to a landlord could assist in future more positive references

Eviction and Court Record:  To determine if there is a reason to challenge the eviction record, make payment plans or reopen a case.

Credit:  To determine if there are mistakes on the credit records, submit explanations for credit reports and otherwise determine if there are things that can be done to repair the credit.

Conviction Record:  To have full disclosure for other residents living in the house and to be discussed during the membershipping process.  Record checks will be purchased through the Madison Police Department.  In order to be denied based on criminal record we will consider the if the crime is related to housing, how long ago the crime occurred (may be denied even if off paper more than 2 years ago unlike former city ordinance), location the crime took place, the possibility of recurrence.  Sex offenders may be excluded depending upon the specific offense due to the presence of childrens programs in the area.

Additional Rules
Pets will go through a similar membershipping process (yet to be developed).  Service animals will be allowed and the presence of a service animal cannot be a reason for denial.

Must be at least 18 years of age unless parents are living in the building or they have permission of the parent or guardian.

Denial
Any denial shall be put in writing and given, mailed, or emailed to the applicant that has been denied within 5 days of the decision.

Appeal
Decisions to deny membership may be appealed to the Board of Directors within 14 days of written notice of denial.  The applicant will be given an opportunity to review application file and has the right to present evidence and witnesses in support of the application before the Board of Directors.

Approval
Upon final approval, the applicant will be asked to sign a lease and house rules.  Prior to this point, the person is a guest and may be asked to leave at any time.

HOUSE RULES
House members and their guests will be expected to:
- Always show respect for others and yourself.
- Refrain from harassment, discrimination or abusive conduct (see definitions below)
- Attend House meetings twice a week.
- Participate in conflict resolution training.
- Serve on the grievance committee rotation.
- Participate in household chore rotation.
- Be actively working on goals (ex. seek employment, seek benefits (SSI, SSDI), address mental health and medical issues, AODA treatment)
- Participate in trainings offered to house residents.
- Pay rent or provide work hours in lieu of rent.
- Keep your room in clean, safe and sanitary condition.
- Refrain from littering
- Smoke in the smoking area (need to designate the smoking area with the help of the neighbors)
- Refrain from loitering or trespassing on or near neighboring properties
- Follow park rules
- Refrain from engaging in illegal activity
- Not invite “crashers” in the non-residential portion of the building.
- Have guests sign in if they stay in the residential portion of the building.
- Have a roommate agreement regarding guests before inviting guests to stay over night.
- Have your guests become a member of Occupy Madison, Inc. if they stay frequently.

Note:  - Guests will be allowed according to law.  Madison General Ordinances state that 32.05(1)(g)

A landlord may regulate guests, but may not prohibit, a tenant from having all guests.

Guest regulations, if any, shall be included in the rental agreement. Guest regulations

shall be in conformance with the definition of a Family provided in Chapter 28 of

Madison General Ordinances. Guest regulations shall not permit the violation of zoning regulations, including capacity standards, provided in Chapter 28 of Madison Genera Ordinances. Nothing in these ordinances shall prohibit a landlord from commencing an eviction action against a tenant for permitting a person to reside in the tenant’s rental unit in violation of Madison General Ordinances or state law.

 

HARASSMENT AND ABUSIVE CONDUCT
Occupy Madison, Inc is committed to maintaining a positive environment for its members and guests.  All individuals have the right to enjoy an environment free from all forms of conduct that can be considered harassing, threatening or intimidating. True cooperation can exist only when every person is free to pursue expression of ideas in a non-threatening atmosphere of mutual respect. Occupy Madison, Inc. is committed to protecting freedom of expression of all members and this policy against harassment and abusive conduct will be applied in a manner that protects those freedoms.  Harassment and abusive conduct are offensive, impair morale, undermine the integrity of relationships and cause serious harm to the productivity, efficiency and stability of our organization.  They are unacceptable and threatening to the success, well-being, and growth of all members of our community and will not be tolerated. This policy applies to all members, officers and staff.

Definition: Harassment
Harassment: Unwelcome verbal or physical conduct or discrimination based on race, color, creed, ancestry, national origin, age, disability, sex, arrest or conviction record, marital status, sexual orientation, membership in the military reserve or use or nonuse of lawful products away from work, or any other protected class.  This also includes sexual harassment, defined as unwelcome, severe, and pervasive verbal, visual, or physical conduct of a sexual nature.

Definition: Abusive Conduct
Abusive Conduct: Behavior that creates an intimidating environment and is likely to interfere with an individual’s work or home life.  This conduct can be verbal, physical, or communicated in writing or electronically.  Examples include but are not limited to:

  • Threatening or intimidating behavior or words
  • Obscenities or profanities directed towards an individual or group
  • Degrading a person or a group
  • Taunting, jeering, mocking or humiliating another person
  • Screaming and/or yelling at or around others
  • Insulting someone or their performance, especially in the presence of others
  • Endangering the safety of an individual or individuals

Discussion is had and Betty Ybarra and Chris Derrick agree to be co-secretaries and that passes by unanimous consent.

 

Treasurer:

Jeremy Evenson nominates Kieth Valiquette to be treasurer, Loretta Manuel seconds.

Daniel Callahan nominates Russ Albers to be treasurer, Erica Kuffler seconds.

 

Vote:     Russ Albers* = 4 votes plus 3 proxies = 7

Kieth Valiquette* = 6 votes

7.  Recommendation of authorization of signatories for new bank account

Prior to making a motion, there is a discussion that the treasurer and someone should be the signers and Keith Valliquette seemed to be a natural since he is a CPA and so Jeremy Evenson made a motion to make Keith Valiquette a co-treasurer with Russ Albers.  Chris Derrick seconded and it passed on unanimous consent.

Jeremy Evenson made a motion that Russ Albers and Kieth Valiquette are authorized to open a bank account on behalf of Occupy Madison at Summit Credit Union, Heartland Credit Union or any other credit union if those do not work out and are authorized to sign checks as authorized by the membership or board of directors as appropriate which includes checks necessary to implement the budget as proposed.  Checks will require two signatures, even if the credit union will not check for two signatures, we will check internally.  The motion passes by unanimous consent.

 

3.  Potential Changes in Membership – Change to the by-laws

Keith Valliquette made a motion that Brenda Konkel be a member, seconded by Chris Derrick.

Jeremy Evenson made a motion that Bruce Wallbaum be a member, seconded by Betty Ybarra.

Keith Valliquette made a motion that Allen Barkoff be a member, seconded by Ronnie Barbett.

Chris Derrick made a motion that Luca Clemente be a member, seconded by Betty Ybarra.

Kieth Valliquette made a motion, seconded by  Jeremy Evenson that they following people be added to membership:

7.  Recommendation of authorization of signatories for new bank account

Bruce Wallbaum makes a motion that the address to be used on the bank account is Brenda Konkel’s house where several members receive mail and checks for fundraising are currently being mailed.  The address is  30 N Hancock St. Madison, WI 53703.  The motion passes without discussion by unanimous consent.

 

8.  Move to Adjourn

Bruce Wallbaum moves to adjourn.  Keith Valiquette seconds.  Motion passes unanimously.

Call meeting to order.

Press Coverage & Filling in Mistakes

We have been receiving a fair amount of press coverage of late, and unfortunately some of it is inaccurate. We appreciate the time from WKOW segment yesterday, but here is a correction from Bruce:

Occupy Madison applied for a loan through the affordable housing trust fund. Channel 27 misrepresents the funding aspect. The deadline for the loan was due on Dec 7th, OM submitted an application to keep all funding avenues open. Currently OM is finalizing the details to begin fundraising. The goal is to launch the project through fundraising and sustain it through member participation and working cooperatives. All of the funding details are still being worked out. OM is meeting with the neighborhood associations and other organizations in the area to develop the project with as much community input as possible.

Ed adds:

It should be noted that the city funds would be in the form of a 10-year loan, not a direct subsidy.

We will be adding additional corrections as needed and able.
